The Martin County Planning Commission/Board of Adjustment will be conducting a public hearing on October 27, 2020 at 5:30 p.m. The hearing will be held in the Martin County Commissioners Room, located on the first floor of the Courthouse, 201 Lake Avenue – Fairmont, MN. The following items will be on the agenda:
Variance Request from Dennis & Lynn Sovell within Section 34 of Fox Lake Township. The Sovells would like to place a septic system closer than the required setback from the road right-of-way; the garage, and the east side yard setback on Fox Lake in an “SL-2” Shoreland Residential Recreational District. The Martin County Sewage and Wastewater Ordinance require a minimum of 10 feet to the road right-of-way; 20 feet to a building; and 10 feet to a property line.
Variance Request from Jeremiah (J.R.) Pooley within Section 9 of Silver Lake Township.
The Pooleys are proposing to build an addition and deck onto an existing house encroaching closer than the minimum required setback from the centerline of the public right-of-way in an “A” Agricultural District. The Martin County Zoning Ordinance requires a 200 foot setback from the centerline of any public right-of-way for a new building site effective February 17, 2004 and one hundred and thirty (130) feet from the centerline of any public right-of-way for existing building sites constructed before February 17, 2004. Existing building sites cannot further encroach closer than the nearest present building from the centerline of the road provided greater than 130 feet from the centerline in an “A” Agricultural District.
